What to Do if a Family Member Was Killed in a Truck Crash in Alabama

Losing a loved one in a crash involving a commercial truck is devastating, and these cases come with unique legal challenges in Alabama. Because trucking accidents often involve federal regulations and high-limit insurance policies, what happens in the days following the crash can be especially important.

Alabama law is different from most states when it comes to wrongful death claims. Damages are purely punitive, meaning the focus is on holding the at-fault party accountable rather than compensating for financial losses. As a result, proving negligence, such as violations of safety rules or poor vehicle maintenance, becomes central to the case.

Only a court-appointed personal representative of the estate can file a wrongful death claim. If one hasn’t been named, the probate court will appoint someone, often a close family member.

Preserving evidence is also critical. Commercial trucks contain “black box” data that can show speed, braking, and driver behavior before the crash. This information can be lost if not secured quickly, so early action is key.

Alabama also follows a strict contributory negligence rule. If the victim is found even slightly at fault, recovery may be barred. Because of this, a thorough investigation, using evidence like witness statements and crash reconstruction, is essential.

Finally, trucking companies are regulated by federal safety standards. Reviewing driver records, training, and company practices can help determine whether broader safety failures played a role in the crash.
