Why You Need Legal Help After a Pedestrian Accident in Tuscaloosa

When an accident involves a pedestrian in Tuscaloosa, the physical and legal challenges are immense. Alabama’s unique legal environment makes professional legal guidance a necessity to protect your future.

1. Navigating Alabama’s Contributory Negligence Law

Alabama is one of the few states that still follows the doctrine of pure contributory negligence. This means that if a pedestrian is found to be even 1% at fault for the accident (such as crossing outside of a crosswalk), they may be barred from recovering any compensation at all.

A lawyer can help you prove that the driver was 100% at fault, using witness statements and reconstruction data to shield your from unfair blame.

2. Securing Evidence from the Scene

A lawyer will immediately work to secure evidence, such as footage from traffic cameras or surveillance from nearby businesses. This data can prove whether the driver was speeding, distracted by a mobile device, or failed to slow down in a high-pedestrian area, providing the proof needed to overcome insurance company denials.

3. Investigating Driver Last Clear Chance

Even if a pedestrian was in the roadway, Alabama law recognizes the Last Clear Chance doctrine. This holds that if a driver saw the pedestrian in peril and had the opportunity to avoid the collision but failed to do so, they can still be held liable.

Proving this requires a technical analysis of braking distances and sightlines, which a personal injury lawyer performs through expert accident reconstruction.

4. Identifying All Sources of Insurance Recovery

In many pedestrian cases, the driver’s insurance policy may not be enough to cover the cost of life-threatening injuries. A lawyer will investigate all potential avenues of recovery, including the driver’s personal assets, potential employer liability if they were working at the time, and the victim’s own Uninsured/Underinsured Motorist (UM/UIM) coverage.
