Lee County, AL (June 13, 2026) – A head-on collision claimed the lives of two individuals in Lee County on Friday morning, June 12.

The Alabama Law Enforcement Agency (ALEA) said the crash took place near the intersection of Alabama 169 and Lee County 140, which is roughly seven miles north of Opelika

Preliminary reports indicate that a passenger car driven by an 80-year-old Salem resident was traveling along the highway when it collided head-on with an oncoming vehicle driven by a 32-year-old Opelika motorist. The structural impact between the two vehicles was catastrophic, causing extensive damage to both front ends and instantly trapping the occupants.

Emergency medical personnel and the county coroner rushed to the scene to provide aid, but the trauma proved fatal for two individuals. The 80-year-old driver of the first vehicle and a 47-year-old passenger riding in the second vehicle sustained fatal injuries and were both pronounced dead at the scene.

The specific actions that caused the vehicles to cross the center line remain unknown, and the crash is under active investigation by troopers with ALEA’s Highway Patrol Division.

Our hearts go out to the families and loved ones of the people who lost their lives.

What Damages Can Surviving Family Members Recover Under Alabama’s Unique Wrongful Death Statute?

Under Alabama’s unique wrongful death statute, surviving family members can only recover punitive damages, which are designed entirely to punish the at-fault driver's negligence and deter others from reckless behavior, rather than compensating the family for economic losses.

Unlike every other state in the country, Alabama Code Section 6-5-410 does not allow the recovery of compensatory damages, such as funeral costs, medical bills, or lost future earnings, in a wrongful death lawsuit. Instead, the jury determines the financial award based strictly on the severity of the negligent motorist's wrongdoing and the necessity of preserving human life.

Because the focus of an Alabama wrongful death action is exclusively punitive, the personal representative of the deceased's estate faces a remarkably high burden of proof.

To secure a recovery, they must build a compelling case that highlights the explicit recklessness of the at-fault motorist. Anticipating this, insurance adjusters will carefully scrutinize police accident reports, vehicle black box data, and scene photographs to see if there is any ambiguity regarding which vehicle crossed the roadway.

Ultimately, if the evidence does not clearly demonstrate gross negligence or a major traffic violation, the insurance carrier may aggressively dispute the claim to avoid paying out a high punitive award.

To counter these defensive tactics and safeguard the claim, a lawyer can provide crucial assistance during this challenging time by launching an immediate, independent investigation. Prompt action enables an attorney to preserve critical highway evidence, analyze forensic debris patterns, and secure vital witness statements before they are lost or destroyed.

Furthermore, this proactive legal guidance helps protect the estate's rights by navigating the highly specialized procedural rules required to file a wrongful death claim in an Alabama civil court.

By managing all communication with police and third-party insurance adjusters, an experienced attorney shields the grieving family from administrative stress, allowing them to focus entirely on supporting one another through their recovery.
