Next Steps for Families After a Fatal Accident in Alabama
In Alabama, the legal path after a fatal crash is unique because the law focuses on punishing the at-fault driver rather than strictly "reimbursing" the family.
You cannot file a lawsuit as a spouse or child directly; instead, you must first petition the Probate Court to appoint a Personal Representative for the estate. This representative is the only person with the legal "standing" to seek justice for your loved one.

In Alabama, only the Personal Representative (also known as an Executor or Administrator) can file a wrongful death claim.
If your loved one had a will, it likely names this person. If not, Alabama law generally prioritizes the surviving spouse, followed by the next of kin.
You have a 40-day window from the date of the death to petition the Probate Court for this role. If the family does not act within this time, the court may appoint an administrator of its own choosing to manage the claim.
In Alabama, the wrongful death law focuses entirely on punitive damages. Unlike other states, a jury does not calculate a settlement based on medical bills, funeral costs, or the victim's future earnings.
Instead, the award is intended solely to punish the at-fault driver's negligence and deter similar behavior in the future.
Since these are punitive damages, they are not subject to the deceased's debts, meaning creditors and hospitals cannot take this money to pay off the victim's outstanding bills.
Furthermore, the recovery is distributed directly to the heirs according to Alabama’s intestacy laws, which are the state's default rules for inheritance. These rules apply regardless of what a will might say, ensuring the funds go directly to the family.
To begin this process, a Personal Representative must be appointed through the Probate Court, as they are the only individuals with the legal standing to file a claim.
